According to EU Regulation 261/2004, if your flight is cancelled less than 14 days before its scheduled date, you will be entitled to receive financial compensation of up to €600.



THE COMPENSATION AMOUNT DEPENDS ON THE DISTANCE OF THE FLIGHT

up to 1500 km 250€ Short-haul
between 1500 and 3500 km 400€ Medium-haul
over 3500 km 600€ Long-haul


YOU WILL NOT BE ENTITLED TO COMPENSATION IN THE FOLLOWING CASES:


  • 1 Cancellation more than 2 weeks in advance:
    If your flight is cancelled over 14 days before its scheduled date, unfortunately you cannot claim compensation due to flight cancellation.
    Despite not being entitled to compensation, the airline will have to refund the amount of your ticket or offer an alternative flight.
  • 2 “Extraordinary” circumstances:
    The airline would be exempt from paying this compensation if it can prove that it was caused by extraordinary circumstances, such as strikes, natural catastrophes, terrorist threats, or others that may vary depending on the nationality of the jurisdiction of the case. Airlines often use “extraordinary circumstances” as an excuse to deny a passenger the corresponding compensation. Most passengers lack the knowledge and experience to investigate these circumstances or, due to being involved in a long and annoying process, withdraw their claim so as not to run up legal costs. This is precisely why we are here to help you, so you can avoid all of this.  Remember: If you do not win, we won’t charge you a thing.

EU Regulation 261/2004 guarantees compensation of up to €600 per passenger on flights with delays of three hours or more, that is, when they arrive at their final destination three or more hours later than the time initially scheduled by the airline.

YOU WILL NOT BE ENTITLED TO COMPENSATION IN THE FOLLOWING CASES:


  • 1 Delay of less than three hours:
    If your delay is less than three hours, you are not entitled to compensation as set forth in the law of EU Regulation 261/2004. Even so, if your flight is delayed by at least two hours, you can then request assistance from the airline (food, drinks, snacks, etc.).
  • 2 “Extraordinary” circumstances:
    The airline would be exempt from paying this compensation if it can prove that it was caused by extraordinary circumstances, such as strikes, natural catastrophes, terrorist threats, or others. Airlines often use “extraordinary circumstances” as an excuse to deny a passenger the corresponding compensation. Overbooking or denied boarding occurs when the airline sells more seats than the plane has. Denied boarding not only covers excess booking situations, but also those for operational reasons.

So long as the denied boarding is not voluntary, that is, when the company imposes the overbooking on you even though you have not accepted it, you would be entitled to financial compensation according to EU Regulation 261/2004.

YOU WILL NOT BE ENTITLED TO COMPENSATION IN THE FOLLOWING CASES:


  • 1 The overbooking is voluntary.
    In this case, you would be entitled to the benefits offered by the company but not to claiming for the compensation established according to EU Regulation 261/2004.
    If you decide voluntarily, the airline has to give you one of these options:
    • Refund within 7 days of the cost of the ticket corresponding to the part of the trip not made, together with, where appropriate, a flight back to the first departure point as quickly as possible.
    • Refund within 7 days of the full price of the ticket when it was purchased, corresponding even to the part or parts of the trip made, if the flight no longer makes sense with respect to the passenger's initial travel plan, and, where appropriate, a flight back to the first departure point as quickly as possible.
    • Transfer to the final destination as soon as possible under comparable transport conditions.
    • Transfer to the destination under comparable conditions on another date that suits the passenger.
